Riccardo Vitti, 33, of New Jersey, and his wife, Giorgina, 20, have been charged in a federal court in Philadelphia, Pennsylvania, with fraud and false claims of taking the drug.
The alleged fraud took place after Vitti’s pharmacy, known as “the Pharm Party,” closed a Nexium-all-day sale and sold the drug to customers at a discount.
Vitti, who lives in North Carolina, was sentenced to three years in federal prison and a fine of $250,000, and was ordered to pay $1 million in restitution.
The state has a policy that allows people to sell prescription drugs without a prescription, and people who sell drugs are subject to seizure, the government reported.
The Food and Drug Administration (FDA) in Philadelphia announced that Vitti and his wife, Giorgina, who lives in North Carolina, are in the process of paying the full price of $7,000 to the pharmacy at the door, according to the agency.
